“Platform”), owned and operated by URBANALAY REALTECH SERVICES. (referred to as
“Company”, “we”, “our” or “us”). By accessing, registering, or using our
website, you (“User”, “you”, or “your”) agree to comply with and be bound by
the following Terms of Use (“Terms”), Privacy Policy, and other policies
referenced herein.

1. Eligibility

under the Indian Contract Act, 1872.

Urbanalay, you represent and warrant that you meet all eligibility

- Urbanalay
provides a digital marketplace for listing, searching, buying, and selling
properties in West Bengal and across India.
- We also
offer related services such as home loans, interior solutions, legal
advice, and property insights through affiliated vendors or service
partners.
- Urbanalay is
only an intermediary under the Information Technology (Intermediary
Guidelines and Digital Media Ethics Code) Rules, 2021 and does not own or
directly sell any properties.
3. User Responsibilities
- You agree to
use the Platform only for lawful purposes and in compliance with all
applicable Indian laws, including RERA (Real Estate Regulation and
Development Act, 2016).
- You must
ensure that all information you provide (property listings, personal
details, etc.) is accurate, true, and not misleading.
- You agree
not to upload or post any content that is defamatory, obscene, offensive,
or violates the intellectual property rights of others.
- Users
(sellers or agents) must ensure properties listed comply with necessary
approvals, permissions, and disclosures as per applicable real estate
laws.
4. Listings & Transactions
- All
property-related data displayed on the Platform is based on information
provided by the sellers, brokers, or developers.
- Urbanalay
does not guarantee the authenticity, accuracy, legality, or ownership of
the properties listed.
- Buyers are
advised to conduct independent due diligence and verify the legal title
and regulatory compliance of any property prior to entering into any
transaction.
- Urbanalay
shall not be liable for any losses, damages, or disputes arising from user
transactions.
5. Payment Terms
- Certain
services may be chargeable (such as premium listings, lead generation, or
marketing services).
- All
payments, if applicable, are to be made in Indian Rupees (INR) through the
authorized payment gateway integrated on the Platform.
- Payment does
not guarantee sale, purchase, or closure of any transaction.
6. Intellectual Property
- All content,
trademarks, logos, and service marks displayed on the Platform are the
property of Urbanalay or its licensors and protected under applicable
Indian intellectual property laws.
- You agree
not to reproduce, distribute, modify, or commercially exploit any content
without prior written consent.
7. Third-Party Links
- The Platform
may contain links to third-party websites or services. Urbanalay is not
responsible for the content, accuracy, or practices of these external
sites.
8. Limitation of Liability
- Urbanalay
shall not be liable for any direct, indirect, incidental, consequential,
or punitive damages arising out of your access to or use of the Platform.
- Urbanalay's
total liability to you, for any reason whatsoever, will be limited to the
amount paid by you (if any) for services availed from the Platform.
9. Indemnification
You agree to

employees, and agents from any claims, liabilities, damages, losses, and
expenses, including reasonable attorneys’ fees, arising out of or related to
